1. GENERAL PROVISIONS

1.1. This User Agreement (hereinafter referred to as the Agreement) is a public offer and defines the conditions for providing access, use of materials and services posted on the website of the St. Petersburg State Budgetary Cultural Institution St. Petersburg Mussorgsky State Academic Opera and Ballet Theatre — Mikhailovsky Theatre (hereinafter referred to as the Mikhailovsky Theatre), located on the domain name www.mikhailovsky.ru.

1.2. This Agreement governs the relationship between the Mikhailovsky Theatre and the Website User.

1.3. The User expresses his full and unconditional agreement that the use of the Website, as well as any of its parts, in any way implies the fact that the User has familiarized himself with this Agreement and means full and unconditional agreement with its contents. If the User does not accept the terms of the Rules in full, the User is obliged to refrain from using the Website.

1.4. Personal data processing is carried out in accordance with the privacy policy of the Mikhailovsky Theatre regarding website users’ personal data processing.

2. DEFINITIONS OF TERMS

2.1. The following terms have the following meanings for the purposes of this Agreement:

2.1.1. Website Administration: employees of the Mikhailovsky Theatre or involved third parties acting on behalf of the Mikhailovsky Theatre authorized to administer, manage, provide technical support for the website and other actions related to its use.

2.1.2. User of the Mikhailovsky Theatre website (hereinafter referred to as the User) is a person who has access to the website via the Internet and uses the Website.

2.1.3. Website is the website of the Mikhailovsky Theatre, located on the domain name www.mikhailovsky.ru.

2.1.4. The content of the Mikhailovsky Theatre website (hereinafter referred to as the Content) is protected results of intellectual activity, including fragments of audio-visual works, their titles, prefaces, annotations, articles, illustrations, covers, with or without text, graphic, text, photographic, derivative, composite and other works, user interfaces, visual interfaces, logos, as well as design, structure, selection, coordination, appearance, general style and arrangement of this Content included in the Website and other intellectual property objects collectively and/or individually contained on the Mikhailovsky Theatre website, personal account with the subsequent opportunity to purchase tickets at the Mikhailovsky Theatre.

3. SUBJECT OF THE AGREEMENT

3.1. The subject of this Agreement is to provide the Website User with access to the services contained on the Website.

3.1.1. The Mikhailovsky Theatre website provides the User with the following types of services:

— access to information about the Mikhailovsky Theatre and information about purchasing tickets on a paid basis;

— purchase of electronic tickets;

> — provision of discounts, promotions, benefits, special offers

— obtaining information about news and events of the Theatre, including distribution of information and news messages (by e-mail, telephone, SMS);

— access to electronic content, with the right to view the content;

— access to search and navigation tools;

— other types of services implemented on the pages of the Mikhailovsky Theatre website.

3.2. This Agreement governs all existing (actually functioning) services of the Mikhailovsky Theatre website, as well as any subsequent modifications thereof and additional services that appear in the future.

3.3. Access to the Mikhailovsky Theatre website is provided free of charge.

3.4. This Agreement is a public offer. By accessing the Website, the User is deemed to have acceded to this Agreement.

3.5. The use of materials and services of the Website is governed by the current legislation of the Russian Federation.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. Responsibilities of the Website Administration:

4.1.1. Provide the User with access to the Website in accordance with the terms of this Agreement, with the exception of periods of Website suspension on the basis of Art. 4.2.2.

4.1.2. Take generally accepted technical and organizational measures aimed at ensuring the safety of the User’s information.

4.1.3 When processing personal data, strictly observe the current legislation of the Russian Federation and the policy of the Mikhailovsky Theatre regarding personal data processing.

4.2. Rights of the Website Administration:

4.2.1. Make changes and additions to the text of the Agreement, as well as change the content of this Website. Changes to the terms of use come into force from the moment the new version of the Agreement is published on the Website.

4.2.2. Suspend the operation of the Website if significant malfunctions, errors and failures in equipment and software are detected, as well as for the purpose of carrying out preventive maintenance and preventing cases of unauthorized access to the Website.

4.2.3. Carry out various promotions to attract Users and other third parties to use the functionality of the Website at personal discretion and at any time.

4.2.4. The website administration has the right to delete the User’s account and (or) suspend, limit or terminate his access to any of the Website services if it finds that, in its opinion, such a User poses a threat to the Website and (or) other users and (or) violates the terms of this User Agreement.

4.2.5. Process the User’s personal data without obtaining the User’s consent solely for the purpose of executing this User Agreement to the extent necessary for the execution of this User Agreement and in accordance with paragraph 5 part 1 Article 6 of the Federal Law of July 27, 2006 No. 152-ÔÇ „On Personal Data“.

4.3. The user has the right:

4.3.1. To register on the Website. Registration of the User on the Mikhailovsky Theatre website is carried out for the purpose of identifying the User for the provision of Website services, distributing information and news messages (by email, telephone, SMS, other means of communication), receiving feedback, accounting for the provision of benefits, discounts, special offers and promotions.

4.3.2. Use all services available on the Website.

4.3.3. Ask any questions related to the information posted on the Mikhailovsky Theatre website.

4.3.4. Use the Website solely for the purposes and in the manner provided for in the Agreement and not prohibited by the legislation of the Russian Federation.

4.4. Website User undertakes:

4.4.1. Not to take actions that may be considered as disrupting the normal operation of the Website.

4.4.2. To avoid any actions that may violate the confidentiality of information protected by the legislation of the Russian Federation.

4.5. The User is prohibited from:

4.5.1. Using any devices, programs, procedures, algorithms or methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the content of the Website.

4.5.2. Bypassing the navigation structure of the Website in any way to obtain or attempt to obtain any information, documents or materials by any means that are not specifically provided by the services of this Website.

4.5.3. Violating the security or authentication systems of the Website or any network connected to the Website. Perform a reverse search, trace or attempt to trace any information about any other User of the Website.

4.5.4. Use materials from the Website without the consent of the copyright holders.

5. USE OF THE WEBSITE

5.1. The Website and the Content of the Website are owned and operated by the Mikhailovsky Theatre.

5.2. The Content of the Website cannot be published, reproduced, transmitted or distributed in any way, or posted on the Internet without the written consent of the Mikhailovsky Theatre.

5.3. The User is personally responsible for maintaining the confidentiality of account information, including the password, as well as for any activities conducted on behalf of the Account User.

5.4. The user must immediately notify the Mikhailovsky Theatre of any unauthorized use of his account or password or any other breach of security.

6. RESPONSIBILITY

6.1. Any losses that the User may incur in the event of an intentional or careless violation of any provision of this Agreement, as well as due to unauthorized access to the communications of another User, are not reimbursed by the Mikhailovsky Theatre.

6.2. The administration of the Mikhailovsky Theatre website is not responsible for:

6.2.1. Delays or failures in the transaction process resulting from force majeure, as well as any malfunction in telecommunications, computer, electrical and other related systems.

6.2.2. Actions of transfer systems, banks, payment systems and delays associated with their work.

6.2.3. Improper functioning of the Website, if the User does not have the necessary technical means to use it, and also does not bear any obligation to provide users with such means.

6.2.4. Visiting and using external resources, links to which may be contained on the Website.

6.2.5. The Website Administration is not responsible and has no direct or indirect obligations to the User in connection with any possible or occurred losses or damages associated with any content of the Website, copyright registration and information about such registration, goods or services available on or received through external websites or resources or other contacts of the User that he entered into using information posted on the Website or links to external resources.

6.2.6. The User agrees that the Website Administration does not bear any responsibility and does not have any obligations in connection with advertising that may be posted on the Website.

7. VIOLATION OF THE TERMS OF USER AGREEMENT

7.1. The Mikhailovsky Theatre has the right to terminate and (or) block access to the Website without prior notice to the User if the User has violated this Agreement or the terms of use of the Website contained in other documents, as well as in the event of termination of the Website or due to a technical issue or problem.

7.2. The Mikhailovsky Theatre is not liable to the User or third parties for termination of access to the Website in the event of a violation by the User of any provision of this agreement or other document containing the terms of use of the Website.

7.3. The Mikhailovsky Theatre has the right to disclose any information about the User, in cases where this is provided for by current legislation, is necessary for the purposes of complying with the provisions of current legislation or court decisions.

8. DISPUTE RESOLUTION

8.1. In the event of any disagreement or dispute between the Parties to this Agreement, a prerequisite before going to court is to file a claim (a written proposal for a voluntary settlement of the dispute).

8.2. The recipient of the claim notifies the claimant in written of the results of the claim consideration within 30 calendar days from the date of its receipt.

8.3. If it is impossible to resolve the dispute voluntarily, either Party has the right to go to court to protect their rights, which are granted to them by the current legislation of the Russian Federation.

9. ADDITIONAL TERMS

9.1. The user agrees to this Agreement upon first visiting the Website by clicking the „Agree“ button. If the User disagrees with the terms of use of the Website, the User must immediately stop using the Website.
